The federal agency has accused the companies of engaging in age discrimination by terminating a senior sales employee due to her age.

Allegations:

According to the EEOC’s lawsuit, the employee, who had dedicated over a decade of service to Smithfield Foods, was terminated at the age of 59. The company claimed the termination was part of a reduction-in-force within its sales department. However, the EEOC highlighted that five out of the six employees who were terminated were 55 years or older, while the majority of the employees who were spared from termination were under 55. Initially, Smithfield Foods stated the termination was due to the reduction-in-force but later alleged it was due to the employee's refusal to relocate to the company’s headquarters in Smithfield, Virginia. This claim contradicted the fact that the employee had agreed to relocate, a request that was subsequently withdrawn by the company. For approximately 15 months before her firing, she continued to work from her home in the Atlanta area.
