Reliable Maintenance Solutions to Pay $45,000 to Settle EEOC Disability Discrimination Lawsuit
Background:
Reliable Maintenance Solutions operates across various mine sites in Georgia, providing essential quarry services. In March 2021, an experienced dump truck operator, who is a right-arm amputee, applied for a position with the company. The applicant had a history of successfully operating dump trucks and was employed in a similar role at the time of his application.
Allegations:
According to the EEOC's lawsuit, the applicant underwent an interview process with Reliable Maintenance Solutions and was initially assured that his disability would not hinder his employment. After successfully completing the required safety training, the applicant was informed that one of the company's clients was uncomfortable with hiring an amputee as a dump truck operator. Consequently, Reliable Maintenance Solutions rescinded the job offer, citing concerns from their client.
The EEOC alleged that this conduct violated the Americans with Disabilities Act (ADA), which prohibits employers from discriminating against qualified individuals based on their disabilities. The lawsuit (EEOC v. Reliable Maintenance Solutions, Inc., Case No. 2:24-cv-00093-RWS-JCF) was filed in the U.S. District Court for the Northern District of Georgia after pre-litigation settlement efforts through the EEOC's administrative conciliation process failed.
Settlement:
To resolve the lawsuit, Reliable Maintenance Solutions has agreed to pay $45,000 in damages to the applicant. Additionally, the company will:
- Develop and enforce a comprehensive anti-discrimination policy.
- Provide training to all managers and employees on the ADA and disability discrimination.
- Implement procedures to ensure compliance with the ADA, including accommodations for applicants and employees with disabilities.
- Report regularly to the EEOC on compliance efforts for the next two years.
Conclusion:
This settlement underscores the importance of adhering to the ADA, which mandates that qualified individuals with disabilities must not face discrimination in employment. Reliable Maintenance Solutions' commitment to policy reforms and training aims to foster an inclusive workplace, ensuring fair treatment for all employees regardless of disability.
