Amendment to the Illinois Equal Pay Act

Effective January 1, 2025, Illinois House Bill (HB) 3129 introduces new transparency requirements for employers under the Illinois Equal Pay Act. Employers with 15 or more employees must now disclose specific pay and benefits information in all job postings.

Key Requirements for Job Postings:

  1. Pay Disclosure:
  • Employers must include either a specific wage or salary amount or a good faith range that reflects existing pay scales or actual pay ranges for similar positions.
  1. Benefits and Compensation:
  • Postings must include a description of benefits and additional compensation, such as bonuses or stock options.
  1. Link Option:
  • Employers may comply by providing a link to this information on their website.

Internal Promotion Announcements:

  • Employers must notify all current employees about opportunities for promotion no later than 14 calendar days after making an external job posting for the same position.

This amendment reinforces pay transparency and equal opportunity practices, requiring employers to align their processes to comply with these new standards.
